Adult Film - Which and do laws apply?

Expert: Dan Pepper - 6/29/2009

Question
Hi, Dan! I'm planing on making a website that only earns from banners and uses TGP method (if I understand the meaning of tgp correctly it's something like worldsex.com does, right? (warn: explicit contetn)), do any specific laws apply to a site like that or can I just make it as a regular website (i.e. my blog?) only need to find an adult webhost? No child or other illegal sites to be viewd in it.

Thanks.

Answer
I am assuming that you are located in the United States and will be running your operations here.  If this is not the case, please disregard the following.

TGPs that don't use any graphical content containing sexually-explicit conduct, or any simulated sexually-explicit conduct would not be subject to the 2257 regulations (18 USC 2257, 18 USC 2257A, and 18 CFR 75).

You'll still need to comply with non-adult-specific laws, including appropriate website terms and conditions, and if you'll be doing any email marketing, compliance with the federal CAN-SPAM Act as well as state spam laws.
