Adult Film/Starting a Adult Website
Expert: Jim Boyd - 4/8/2010
QuestionHello Jim. I have been really interested in starting my own amateur pornographic website, and just wanted to find out if it is illegal in Texas to own/operate that type of website. Also, I have been doing a lot of looking into the laws regarding the filming, production, and sales of "obscene" material. Still, after spending so much time trying to understand the laws.....I cant seem to grasp what makes something "obscene", and what doesn't. What is the deal with that? Theoretically, I wanna get all material that will be featured on my site.....how would i do that, and what would i need? And so far the hardest thing to do has been finding girls that are willing to go on film. How do you find/approach girls about wanting them to be in a porn movie?
Thanks for Your Time
Arthur
AnswerWhile the are no real legal issues with owning and operating and Adult Site in the State of Texas...you will have several problem with actually producing any content there. This is because the production of such material is ILLEGAL in Texas.
California is the ONLY place in the United States where productions of this type are actually legal. Adult production is legal in California due to a precedent created by a 1988 decision of the California Supreme Court (California vs. Freeman). As a result of that decision, California became the FIRST AND ONLY state where a person can be legally hired to have sex for the purpose of making Adult Material. However, producers are still required to obtain permits before starting any such production. NO OTHER STATE HAS SUCH A PRECEDENT therefore production in any other State is, and will remain, ILLEGAL!
