He asked me to do a promo shoot which included a facial, oral, solo masterbation, and interview no pay for this,,, if it sells then I will get 40% of gross sales,, my concern is, is it legal for him to do this... thank you for your time.  I am 25 yrs old, and live in indiana

I can say with absolute certainty this offer is completely bogus and this moron is just trying to get into your panties.

First off...Adult Film Performers are paid based on the types of scenes they happen to be hired for and are ALWAYS paid immediately after the shooting is complete. The more you are willing to do in a particular scene...the higher your pay. However, their compensation NEVER includes a percentage of the film's sales and no legit Producer would ever make such an offer. This is porn...not Hollywood.

Secondly...I am not aware of a single legitimate Adult Producer operating in Indiana. This is probably because such Productions are not legal in the State of Indiana as it would be a violation of state prostitution/pandering laws. California is actually the ONLY place where such productions are truly legal.

If you are serious about working in Adult Film...I would STRONGLY advise you to find a reputable Adult Talent Agency to represent you. Adult Talent Agents only work with established and reputable Adult Producers thus helping you avoid potentially dangerous encounters with frauds like this guy...
