Adult Film/Legal question

Question
Hi Dan,

I have a quick question. This isn't exactly about the "adult entertainment" industry in the usual sense but I produce bondage pictures and DVD's for different stores. I typically use tons of rope, hand cuffs and duct tape for binding tools. All of it is full consent, of course and the actresses are paid willing participants. I often get asked by many models: "What would happen if you were traveling with your cuffs, tape and rope and got stopped by a Police Officer?" And I often wondered that myself because I do travel a lot and do tons of frequent driving with such gear in my car. Of course the none of the stuff is illegal to have but normal people don't drive around with these things.

If a Police Officer did want to search my car, for whatever reason, and did find these items.. what options would I have? Would I automatically be arrested if they suspect I am kidnapping people with these items in my car? Would I be able to show them paperwork and my cameras? How exactly would I handle this situation?

I often hear stories about people getting stopped with tape and stuff in their car and arrested for suspicious activity or whatever.

Just want to know what I could do if confronted with that situation. Been traveling with gear for 3 years but there's a first time for everything. Thanks

Answer
Chris,

Your question will depend highly upon your particular jurisdiction, and the specific laws in place in that jurisdiction, so I am not able to give you a definitive answer (and I cannot give specific legal advice in this forum anyway).  I would recommend contacting a local criminal defense attorney and seek his/her advice.

Good luck!
Dan
