I don't do criminal litigation, but I am not aware of any of my clients who have been the subject of any criminal prosecution.
The number one mistake new producers make is that they don't sufficiently plan their business. Many "producers" grab a camera and think they can make it in this industry by simply shooting a few scenes. Those producers will die off quickly.
Neither NJ or NY affirmatively permit the production of sexually explicit content, so one is not more permissible than the other. It ultimately is the type of business you run, the manner and type of content you create, and the way in which it is distributed that ultimately determines your risk.
