Thanks, Jim, for the insightful answers, especially with the documentation requirements. On to my questions: I am working on producing one (or more videos) that are NOT Hardcore. However, there could be nude scenes, No explicit sexual acts. Some examples are: Nude male being given a massage by nude female (on the back); Nude female taking a shower/swim,etc. Aside from the model release and docs proving age, will I be subject to the same requirements as the X-Rated movies? Thanks for your info.

According to the law...yes you will be subject to the same requirements.

Title 18 Part 1 Chapter 110 Section 2256 sets the definitions for the entire chapter INCLUDING Section 2257.

According to Paragraph (2) (A) (v) of this Section “sexually explicit conduct” INCLUDES the “lascivious exhibition of the genitals or pubic area of any person” and goes on in Paragraph (2) (B) (i) to say “sexually explicit conduct” INCLUDES “...lascivious simulated sexual intercourse where the genitals, breast, or pubic area of any person is exhibited; “

Even Hollywood films that do nothing more than show a chick walking around topless, or show a simulated sex scene with nudity are subject to these laws. Any nudity at all without being in compliance can send you to jail.
