Adult Film/Filming outside of CA

QuestionHello Mr. Boyd,
My question is in connection to shooting porn outside of CA. There seems to
be more than a large handfull of websites that are producing porn outside of
CA. I would suspect that these people retained some legal advice and are very
well aware of the "People v. Freeman". So my question is why there is such a
lack of heed with these websites. Why are they not being prosecuted?
Thanks appreciate your knowledge in this matter!
AnswerHi Nick,
Unfortunately, they are being prosecuted. In fact the two largest producers in Florida are currently defending themselves in the courtroom.
Clinton McCowen (owner of Ray Guhn Productions) and Paul Little (AKA Max Hardcore owner of Max World Entertainment), are both currently involved in criminal cases due to their operations in the State of Florida. These producers face a wide range of charges including, prostitution, pandering, and racketeering. Little is also facing an obscenity charge. If convicted they are looking at very lengthy jail terms and monstrous fines.
As I have explained many times, just because some people are foolish enough to try to get away with it….DOES NOT make it legal. Sex in exchange for money, regardless of reason or circumstance, is considered prostitution in ALL States. However, thanks to California vs. Freeman, Adult Films can legally be made in California under state issued permits.
