Adult Film/Starting A Production Company

QuestionHi Jim,
Thanks for being part of a forum like this; it really has been a source for good information for me. Here's my situation...My partner and I are looking to launch a production company. My partner has already gotten her feet wet in the acting part of the business, and what we'd like to do is use her exposure to aid in our entrepreneurial endeavor. What we currently have is a cameraman, web designer, and talent. Additionally, we live in southern California, so exposure shouldn't be an issue. My question is; when it comes to crossing our t's and dotting our i's, what details should we really concentrate on? I must admit that I'm a "dreamer", so I don't want to underestimate the work required to establish a successful company. Hopefully my question isn't too broad. Thank you; I really value your insight.

First off, there is absolutely nothing wrong with being a dreamer, just make sure you have a good plan to go along with the dream and are realistic in its execution.
I have no clue who your partner is or the amount of exposure she has had in the industry so, without more info, I really can’t tell you how to use that to your advantage. However, ANY exposure is good exposure, and it’s a great idea to capitalize on it if you can.
From what you are telling me, it looks like you pretty well have you “ducks in a row” from a production stand point, and the fact you are in California is a huge factor in your favor. Especially, considering California is the only place where Adult film production is actually legal.
So here is what I would suggest: COVER THE LEGAL ISSUES!
1) Find a good attorney who specializes in Adult Industry law, and pay very close attention to EVERYTHING he/she tells you.
2) Know, understand and make sure that you fully comply with the Federal Laws that apply to Adult Material. Specifically USC Title18 Section 2257 and CFR Title 28 Part 75. THIS IS NOT AN OPTION!!!
3) Have the attorney I mentioned above work with you on putting together your model releases and contracts.
4) Remember that Adult Film Production is legal in California, ONLY if you have a proper permit.
Please, DO NOT begin work on any projects until you are absolutely certain you understand the legal issues involved. Failing to do so could lead to serious jail time and huge fines. It does not matter if you have been in business 20 minutes or 20 years, the legalities can end it for you in an instant.
Also please understand that this is NOT an easy/quick money business. You may very well have to release several productions before you start to show any serious profit margins.
It would seem to me you are off to a pretty good start. However, You have many long hours of hard work to look forward too.
