Hey,

I have a question, I am  looking into renting from a big
apartment complex. I look on there website and for example
they have a 3 bedroom for 2465.00 and when you call them they
just say no that is the average price the actual is 2565.00.  When
I asked another leasing agent if the ever have or had apartments
for 2465.00 she said no.  This is the same for the 2 bedroom
and some 1's.  Is this the leasing agent just trying to make a
bigger commision? Is this legal?  I also go to sites like rent.com
and there prices are cheaper then what the leasing agent says
they have.  Any help would be great!!  please respond.

It certainly is a buyer beware - but it is $100 misprint if nothing else. I'm certain that if they have advertised the lower price this would be the argument - but it is a cheat regardless.

There are ombudsmen for advertising standards and you could complain (here is an url - http://www.ftc.gov/bcp/menu-ads.htm - and they (the offender) may change but the slap on the wrist will not make them honour the lower price. In fact, they will state that it was a typo, that they TOLD you this when you called (I'm making an assumption), and they will change their ways - but there will be no fine or obligation to do so (I don't believe). The real estate board in your state or Province will have a very strict guideline… BUT, again, will they enforce it?

The price did what it was to do - get your attention - to look. It is unethical. It will happen again. If these are the levels that they are willing to stoop to then fine - you probably will wish to take your business elsewhere.

I'm uncertain if this gives you any comfort, but there is little the consumer can do in this case other than waste your time, possibly get the lower price but have an irate landlord that could make you life miserable.
