how does fair and unfair discrimination and employee protection have an impact in the selection process

I do not fully understand your question here.  If you could expand upon it a little, I will be very happy to answer.  

If you are asking how Title VII of the Civil Rights Act and other employment law protection impacts upon the selection process, these laws protect you from being discriminated against for reasons of protected categories including race, religion, disability, sex, national origin, and color.  Other protected categories are those that are listed by your respective state and/or city.  Other protections include Veteran status.  

Many businesses have an affirmative action plan and actively recruit underpresented groups yet it is not a mandatory requirement (unless court ordered) to hire anyone.  Businesses can hire the best qualified for a position regardless of category.  You cannot be discriminated against in employment application, selection, firing, or during employment.
