IS IT ONLY AN ARRESTABLE CRIME IF THE STOCKER HARMS THE PERSON THIER STOCKING?

Answer
No.  In most, if not all states, stalking is a crime in itself -- even if the stalker causes no physical harm.  Usually the activity has to involve some express or implied threat, or violate a court order.  However, in some states, simply following a person around and being annoying is a crime.
