Question If someone is charged with prostitution or solicitation of prostitution is there a difference between the required evidence by the police if there is a male soliciting from a prostitute or a prostitute soliciting from a male? Do they have to record a male soliciting and not a female prostitute soliciting from a male? Hope you can understand my question. I was told by someone that the police are only required to record a male soliciting.
Answer Hi Michele,
Generally speaking, the equal protection clause prevents discrimination based on sex when interpreting or enforcing laws. Solicitation of a prostitute should require the same standard regardless of the sex of the alleged solicitor or target.
