Air Travel/Duty on used Digital Camera

Question
Dear Roberto,
My parents are visiting my brother in the United States of America for four months now, and will be travelling back shortly. They would be carrying with them a Canon 1Ds digital camera gifted by my brother.
The camera is 5 years old; originally cost 3500 USD(United States Dollar), and my brother had bought it used for 1100 USD (approximately 55000 INR). We have the invoice for $ 1100 from eBay, USA.
What import duties and tariff do you think will be applicable on this camera? Would the duty be calculated on the original price, or the later price? Can we claim a depreciation as this is a 5 year old item?
Many Thanks.

Answer
Dear Vijay,

On the Indian Customs page, at

http://www.cbec.gov.in/customs/cs-act/formatted-htmls/cs-rulef.htm

I did not find any item regarding digital cameras.

But on Appendix C, it is written that returning after 3 months and less than 6 months abroad the amount of non-taxable items are up to Rs. 12,000 for used household articles and Rs. 20,000 for professional equipment.

In doubt you can contact them to clarify this issue. Please see below the link with the appropriated locations:

Hope this helps,
Best Regards,
R. Gomes
