Question
QUESTION: Should a American man have to pay child support in this case yes or no? He got a Belgium women pregnant in a one night stand while in Belgium. Under US and Belgium Law he does not have to pay child support becase there is no child support treaty with the USA.
ANSWER: If he is even aware of the child t hen he may feel compelled to support the child but as in the other case, it is the woman's responsibility to control her reproductive capacity. If she chose to become pregnant in a one night stand, then it is her responsibility. Again, if she is underage, then there could be a rape charge.

QUESTION: Is it fair that if the same American man got a women pregnant in a one night stand in Germany he would have to pay child support even if he never sees that child? There is a child support treaty with the USA and Germany. If the father has to pay child support than he can not fincialy affort to visit the child in Germany.
Answer
In this case, he should demand to know that the paternity of the child is clearly his. He can also sue to demand parental rights since, if he can prove that the child is his, he can claim US citizenship for the child. He may be able to obtain visitation where the custodial parent must send the child to the states periodically. But again, the legal issues of such a case is complex and I am not a legal authority and can not provide advice.
