Question
If I am awarded money for pain and suffering and medical bills first does the
arbitrator decide or alter the original amount requested?  ANd
If awarded funds and the party I am taking to court is an auto insurance
company of the insured who hit me -does the insurance company pay or doI
have to go through getting a process server as some other persons have done
in personal cases?  

Answer

The insurance company pays up to the amount of the policy and the insured pays anything awarded which is not covered under the policy.

The arbitrator decides the total amount of the award, including pain and suffering.  An arbitrator will rarely award what one party requests and will come to an independent decision as to the amount.
