Question
I filed a pregnancy discrimination charge with eeoc. My ex employer said they wanted to settle out of court and they also asked me what is it i want. My lawyer gave them an offer for $75,000. We are waiting on a reply from them now. What happens next if they say no to the offer we made them? What happens if THEY offer an amount im unwilling to take? How long can we go back an fourth on offers? Is there a time limit?

Answer
Chastity,

There is a time limit.  You indicated you filed a complaint with the EEOC.  It sounds like it is in the EEOC Mediation process.  If there is no agreement, eventually the EEOC will find cause or fail to find cause and will issue a "right to sue" letter.  The "right to sue" letter will start the clock and you will have 90 days to file a federal lawsuit.

Very truly yours,
