Arbitration/Mediation - Arbitration and Statue of Limitations

Expert: Dhandapani Saravanan - 5/21/2007

Question
I have a old outstanding credit card and the company is attempting to arbitrate against. One credit report has DLA 11/02 while my recent copy says 6/03. I haven't had any activity on this card since 2001/2002. In Georgia (homestate) the SOL is 4 years. What actions can I take to dispute this attempt?

Answer
Dear Jasmaine,

Once arbitration is initiated it is your obligation to appear before the arbitrator and contest the claim either in person or through your attorney. Depends upon the quantum, it is advisable to contest the claim through an attorney. The last date of transaction is very important to compute the date of limitation.
