Question I have been to arbitration with my ex-husband. Opposing counsel refused to sign the arbitration agreement, so the judge/arbitrator signed it for both attorneys. She stipulated a date that documents had to be turned over to counsel. On that date, opposing counsel did not turn over documents to us, stating that they did not have to turn them over until the judge signed the Binding Arbitration Award. Is this correct? I thought that whatever was stated in the Binding Arbitration Award is what we are to abide by.
Answer Margaret,
You need to give me alot more information regarding this proceeding. First of all, is this in the United States? Second, I need to know what the arbitration regarded. I need to know if this was Court ordered or how it came about to answer your question.
I would be more than happy to help you understand what happened if you could provide me with that information and any other information you believe to be relevant.
