Arbitration/Mediation - CC&R's

Expert: Timmy Chou - 4/16/2007

Question
I live in a gated community with CC&R's that say the ONLY ESTATE home owners can not put their trash containers on the street for pick up. They have to leave them in an enclosed utility yard (which not all the estate homes have as the architectual review board doesn't enforce this) and pay over 2 times as much for trash pick up. The homes patio homes directly across the street from me are allowed to leave their trash cans at the street for pick up. This makes no sense! Can I request mediation as I think if a CC&R rule is considered UNREASONABLE that I have the right to request this. I live in Arizona. Any help would be appreciated.

Answer
Thank you for your question!

Mediators act as neutral third parties to disputes and never "get involved" in judging the merits of conflict, but merely use special techniques to help the parties decide how to negotiate their own settlement. The case you describe here is unfortunately very typical.  I am not a lawyer, nor can I mediate your dispute with just you alone but I can respond to your question from my business consulting experience.

Note that this issue may develop legal implications and you may wish to consult an attorney.

Unfortunately it is not at all uncommon to have conflicting or foolish requirements within CC
