Arts/Crafts Business/Fridge magnet follow-up
Expert: - 11/1/2010
QuestionHi Jane,
I just had one more question as a follow up to my Fridge magnets.
Is there any law that prevents me from selling my interpretation of a building. Example If I love the way a home, such as a brownstone or even a landmark building looks, am I able to draw it, in my unique way with slight variation, to produce a sellable magnet? I would figure the answer is yes considering all the millions of photos out there of landmark buildings. As far as private homes, I am not so sure. If it makes any difference, I am not indicating its address or location, just its look as artwork. I am doing my work in Illustrator so its a cartoon type look and no actual images are being used.
Thanks
Anthony
AnswerHi Anthony,
I am not an attorney - however my understanding is that if you take the photo it is yours to use in any way you want. However if you use someone else's photo you must have permission. The way you are describing everything, I think all is fine.
Best wishes to you!
