Question
My son has had a 504 plan since the 4th grade and now he is in the 9th grade. I have always had routine meetings, but now this new principal wants more testing done for reevaluation. Do I have to agree to this? ADD is a chronic disorder. My son has not changed over summer.I feel I have angered this man when I went over his head on my son's 504 plan and now he is doing this. please help.

Answer
Dear Genn,

There is not one specific answer to your question.  A 504 plan is based upon a diagnosis that requires that your son needs modifications to access the curriculum.  Without those modifications your son is at a disadvantage because the ADHD decreases his alertness.  The only documentation you should need is an MD letter stating that your son has the diagnosis and that it indeed does decrease his alertness.

Academic testing or Psychological testing, I don't believe, is required for a 504 plan as a person with asthma or who is in a wheel chair can have a 504 plan and there is no testing for those conditions.  It is very unusual for a principal to be spearheading this process at all.  I would suggest you talk to the liaison for the exceptional children's or special needs department.  He won't like it but you may have to talk to the liaison about getting this principal more education about 504 plans and ADHD.  It is likely that he does not truly believe in the diagnosis of ADHD and therefore is making a stink.  That's speculation, of course.

I hope that I have given you a starting place.

Many Blessings to you.
