i applied for ssi in august 2009 for my 6 year old autistic son he only has been diagnose by the school district and as of today he has only had two different appointments with two different psychologist but still not receiving the ssi benefits. what can i do to expedite?

Answer
Unfortunately, is seems to be the norm for SSI applications to be denied when you first apply. They should have notified you by now of this denial. You should contact them to find out what the status is of your application. Once you are denied, you have to file an appeal which is also frequently denied. This requires another appeal and it may take appearing before a judge to finally get what your son deserves. I represent my clients through this appeal process, especially when the first appeal is denied. Here is one thing you need to investigate. Are the psychologists used by the school district licensed clinical psychologists? The reason I ask is that school psychologists are not allowed legally to make diagnoses beyond what is impacting school performance. SSI requires diagnoses by licensed clinical psychologists or my medical doctors. This needs to be resolved before you file an appeal. You must have an Autism diagnosis by the appropriate licensed person.
