Question
I was in a car accident and the police determined the other drive at fault. we filed a claim with our insurance but was wondering if her insurance should pay our deductible of 500.00. can we file a claim with her insurance if we have filed with ours. we have state farm.

Answer
State Farm will go after the other insurance company for the money they pay out as well as your deductible.  If they succeed, they will give your deductible back to you when they receive it.

This is called subrogation.  But it make take several months depending on the circumstances.  You can call the other insurer in the meantime and ask them to advance your state farm deductible.
