Auto Insurance Claims/Whos at Fault?

Recently I got into a small accident with one of my coworkers in a parking lot, and although I feel I was not at fault, other are telling me I am.  What happened was: We were going home from work, and half of the driveway was blocked off by cones due to a valet service that they had hired for the night.  There were a bunch of cars coming in, and the only way to exit was through the driveway blocked off by cones.  My coworker stopped at the cones, and i was behind him.  He sat there for about 20 seconds, and then decided to put his car into reverse without looking and the next thing I knew he had hit me.  The damage isn't anything big, about $800 worth.  Although he said he would pay, he is going through his insurance company to do it.  As mentioned before, I have talked to a few people, as well as a few people higher up in the legal system and they are all telling me that in this case it was my fault.  How can that be correct, when I was an appropriate distance behind him, I was just sitting there, and he didn't even look? Their answer: The person behind has more control over their car then the person in front.  Is this correct? Is his inurance company going to say the same thing, and not give me any money for repairs?

Based on your version of events, your co-worker backed into the front of your car while you were sitting still behind him.  If that is the case, I have no idea why anyone would say that you are at fault.  

The person who is backing up bears 100% liability.  The only exception would be if two vehicles back into each other and in that case, each driver is often responsible for their own damages.
