Question
after just recieving a letter from my insurers about a third party saying it was my car that hit hers . My girlfriend has owned up to me and said that when she came out the drs she found the car had rolled as she had not put the handbrake on enough , and not a random car that had hit it with out her knowing . we wre fully comp anyway so god knows why she come out with the made up story . anyway Im just thinking write back straight away and say the truth . whats the insurance responce gonna be like and will there be any come backs off my insurer

Hi Mark,
I agree that this is a situation that needs to be rectified immediately before the 3rd party files a hit & run charge against your car.
If there is a nearby claims office for your insurance company, It would be far better for the two of you to go into the office and make verbal corrections.  This way, your company can see each of you in person and possibly form a forgiving attitude based on the way each of you present yourselves and she can make an apologetic statement that she just panicked.

As it stands right now, she is guilty of FRAUD by making a false report and that is sufficient for your company to cancel your policy.
The more humble that each of you can be will lessen the chance of your policy being cancelled.  This is easier done in person than by
Writing a letter.

If you can't do it in person because there is no local claims office, then I suggest that you call the claims adjuster when she is present so that each of you can talk to him and get a corrected report made and they can immediately arrange to take care of repairs to the other car.

A roll-away is considered a fault accident against the last person who drove and parked your car.
