Auto Insurance Claims/Show photos?

QUESTION: If the injuries are soft tissue such as blue, scratch, burning etc, is it necessary to show the photos to the adverse insurance or medical bills (probably medical records) suffice? The adverse insurance may use those photos to say, “Look, it is not serious but minor injuries” or photos are always recommended. What’s your opinion?


ANSWER: Hi Lou,
In my opinion, you should only provide photo's that will strengthen your case.
This means ones with cuts, blood, broken and/or protruding bones or 'road rash' from your body skidding on the asphalt.

QUESTION: Thank you for your answer. Can the auto personal injuries claim include every loss such as the property loss (totaled car, loss of use of car, property damages in the car) or the property loss should be claimed separately from the personal injuries claim?

Hi Lou,
You are dealing with two entirely separate claims.  The property damage portion can be settled as soon as you can reach an agreement with the insurance company for the value of your car.
The amount of settlement for your damaged car has no bearing on your injury claim, it's based on your severity of injuries, lost wages, medical bills, any long term or permanent injury and your pain and suffering.
If the accident happened in Tennessee, Kentucky or Louisiana, you have a maximum of one year to settle your injury claim or file a lawsuit.  Twenty three other states allow a maximum of 2 years and the remainder allow between three and six years.
If you will send me the name of the state in which the accident occurred, I will reply with the statue of limitations for that state.
