Auto Insurance Claims/Death by vehicle

Question
One week ago, my brother was hit and killed by pickup on the highway. How should I proceed in making a claim on the driver's insurance.  He was arrested for DUI and death by aggravated assault by vehicle.  Should I hire an attorney?

Hello Amanda,

I'm sorry to learn of your loss and send my deepest sympathies.

I think that you should at least consult with an attorney before trying to settle this claim.  The possibility that the driver had assets in a large amount over and above his auto insurance.  Only an attorney can assist you in recovering from the assets of the at fault party.
You need to consult with a personal injury attorney who has trial experience.  If you do not personally know one, just call your local county attorney referral services, explain your needs and they will refer 4-6 qualified attorneys.  The service is free.
In most states, your first consultation with the attorney is also free, in others, there is a minimal charge of about $20 for the first half hour consultation.  You may need to consult with more than one attorney before you find one that you feel comfortable with.
