I was rear ended 3/5/08 by a van owned by a business. The driver is the owner of the business. Ins. policy is $100K. Went to the ER after the accident due to pain in left shoulder. Was in pain pretty much all over. $3500 damage to my car, ended up having shoulder surgery due to rotator cuff tear, was out of work for 7 weeks after the surgery and went for PT for 4 months. What should I expect for a settlement?

It is very difficult to give you a number in any Insurance Settlement as I do not have all the facts.

There are many variables (like your state), and how “injured” your medical records show.

In your case, it would be a good idea to ask a local attorney (do not have to retain them; just see what ball park they think your case is at). You case might be worth the 100K, but depending on what the doctors report, it might be worth 25K….
