Question
I was injured in a car accident. the other side does not want to admit fault, even though they were give a ticket.I don't want a layer, but want to proceed on my own.I need to know where, how ect. to file a statement of claim.the accident happened almost 1 year ago.the ticket was desolved.I have pics of the seen.and wittnessess.I cant work because of my injuries.and I would like to get some sort of resolve soon.

Answer
Hi Jim,
You state that the other party was given a citation but it was "desolved".  I am assuming that the ticket was thrown out and the other party was found not guilty.
Every state has a statue of limitations in which an injury claim must be resolved or you lose all future rights to pursue the claim.
The statue is one (1) year in Tennessee, Kentucky and Louisiana.
The MAJORITY of the remaining states allow two (2) years.  States that don't fall in this category allow from 3 to 6 years.

This will be an extremely complicated case to try to handle on your own.  I strongly reccommend that you at least consult with a personal injury attorney who has TRIAL EXPERIENCE.
In most states the first consultation is FREE or has a minimal charge of about $20.

Otherwise, you can simply file a claim against the other insurance company.
