Auto Insurance Claims/Other driver's insurance dragging feet?

I recently was in an accident in Il.  My vehicle spun out on an icy road, and popped 2 tires.  While my vehicle was sitting there, another driver slid into the front of it.  The other driver's insurance company has looked at my vehicle and assigned an amount.  However, almost a week has gone by, and the other driver has not called their own insurance company to give the official statement.  I keep calling trying to get answers, but the claims contact keeps telling me they can't do anything until they hear the other driver's (their insured) version of events.  Is there a time limit they have to do this?  I'd go through my own company to get my vehicle back, but times are tough and I don't want my rates to go up and I can't really afford the deductible.

I have no idea what the time limit is as I do not know where you live and if there even is a written time limit.

In most states, there is no time limit on a third party claim.  It is your choice to either let your car sit wrecked and file a lawsuit or call your insurance company and have them handle it.

I can tell you that no insurer will accept 100% liability on something like this.  If the ice was so bad that you lost control to start with, then how would any one else be held to a higher standard?

This is why you have insurance.
