Auto Insurance Claims/SDIP surcharge appeal

Question
My car recently skidded in snow on a heavy snow day while driving on express way. The speed at the time was around 30-35mph and traffic was very light. The car skidded in the snow while driving straight ahead and spin around. The front left corner and back bumper damaged by hitting the snow mould.

The car was driven home from site and no other vehicles were involved.

I am waiting for the surcharge notice from insurance agency. I like to know whether the weather condition which caused the accident will help me to appeal.

Answer
Hi Mula,
If your insurance company plans to add a surcharge to your policy due to the accident, it will not take place until your next renewal date.
You will not receive any notification until that point in time.

In the eyes of the insurance company, the accident was not caused due to weather conditions, but due to your driving to fast and/or following to close for the weather conditions that were in effect.
You have no grounds for an appeal.

Every state has a law that requires you to drive in such a manner as to be able to bring your car under control irregardless of what unforeseen circumstances might appear on the roadway ahead of you.
Among many other things, this means driving slower and leaving more space between you and the car ahead in bad weather.

I hope that you find this information to be of help.

Your feedback by rating my response will be appreciated.

Sincerely,
Bennie
