Question
I was involved in a motor vehicle accident.  The hospital billed my health insurance company which paid them.  I submitted a claim to my auto insurer under the med pay provisions.  They mailed me checks for the full amount of medical expenses I incurred with all providers except one, the one my health insurer had already paid.  They mailed a check directing to this provider two months after the provider had been paid and the provider returned the payment to my health insurer and kept the med pay payment because it was for the full amount of the bill as opposed to the contracted amount with the health insurance company.  Can I recoup the med pay and force the provider to accept the health insurer's payment?

It's certainly worth while to try.
As I see it, the hospital had no legal right to reverse a payment that they had received months ago and keep the larger check from your auto medical coverages.
