Auto Insurance Claims - Rear ended

Question
We were stopped on the freeway and were rear ended by a group of teenagers.  They asked us if they could say that one of their passenges was in our car because they had to many, they also changed drivers.  This was all told to the CHP. My question is that we were in the process of changing insurance companies.  Since I do not have insurance am I at fault or are the for running into me.

Lyndsay,

These are separate issues. The fact you were without insurance does not excuse the teens for liability for damages to you, unless your state has some penalty for that. Also check to see if you have a "grace period" on your insurance policy, usually 15 or 30 days of coverage after the expiration date.
