Auto Insurance Claims/backing out of parking space-who's at fault

Question
I was backing out of a parking space when another vehicle pulled behind and I stopped, the guy kept going and he pulled into the spot next to me, which I didn't realize as I was still looking over my right shoulder to see if anybody else was coming so I could pull out.  I continued to pull out of my space and as i swung my car around the front drivers bumper hit the guys back quarter panel. Am I entirely at fault as the guy could clearly see that I was pulling out and I was not aware of his presence?

Based on how you described the sequence of events, I would say that you were at fault, since his car was parked and your car hit his quarter panel while it was still moving. As for his recognition of your lack of awareness, that would not be a good defense.
