Question
I was in an accident, rear - ended and the other parties insurance company is making an offer to settle.  They stated that since my insurance company covered $5000 in medical bills (which i had on my policy); that cannot be considered in valuating my claim.  Is this true?

Hello Jeni,

Well, this does not sound right... at all...

The medical bills and records must be taken into account. However, your insurance company will be paid back for those $5,000. So, when giving you the offer, the $5000 will not be included (unless you live in Arizona or Montana).

The records however are part of your injury evaluation and need to be taken into account when looking at pain and suffering.
