Auto Insurance Claims/funds held by atty 3 years after auto accident

Question
Is it legal for the atty. who settled my accident to hold approx. $4000.00 of monies still after 3 years and to keep sidestepping me by saying his secretary must not have received all the information from my medical insurance co.  Then gets off the telephone real fast.

Well, is it legal? Probably. Is it Ethical? probably no.

3 years and no money? and the attorney is not giving you a straight answer?

It maybe something explainable and the lawyer maybe innocent (probably is), but it sure looks suspicious. Contact your state bar association and ask them to look into the matter. They might contact him/her and get you straight answer.
