If a person was hit by someone about 4 years ago and had back problems and got hit again and it aggravated the back problem again, can they claim PIP and do they need a lawyer for that?  Also is it ok to talk to a adjuster before talking to a lawyer? Or are they out to discredit the individual's claim?

Hello Rose,

If your “new” accident has been recent and you still within your statute of limitations (every state is different), then you can certainly make a claim (if you carry PIP coverage). You should not need a lawyer for filling a PIP claim, however, if the insurance company gives you the run around, then you might consider talking to lawyer. Insurance companies do try to discredit claims, but if you have solid evidence, you can probably get this covered.

One more note: You titled your question as filing claim for pain and suffering. Your PIP coverage will not pay for pain and suffering. You will have to go against the person who cause the re injury (the at-fault party) to get compensated for that. PIP only covers medical bills.
