Morning Anne, on Dec 13th 2008 my husband and I were hit  during a police chase. The bad guy being chased hit us sending us flying into the air and our car landed on the roof. Of course he had no insurance and a suspended license. I am using my uninsured coverage of $500,000. I am just now after 3 months, getting the ok to return to work and just found out that my postition as manager has been given to another employee. I have been offered the Asstistant position which means a cut of $3.50 an hour and 20 less hours a week. Can I expect to recover from the insurance claim, the difference in pay and hours for the year that I think it will take me to gain back the position as manager? If I quit this job will I still have the right to claim this loss?  Thank you for your help in this matter.

HOWEVER, do know that insurance companies will fight this type of thing to the end. Why? Because there is a lot of value there – Not only on the hours you lost, but they hours you will forever lose (the demotion). Your earning capacity has decreased due to this accident. Insurance companies will argue that you must show the causal relationship between the injury and you losing your job hours and the demotion. They will try to argue that you were demoted for some other reason ( you were not a hard worker, depression, etc. etc) Believe it or not, finding a this relationship is somewhat difficult to show. You might have a very good claim, and you really need to at least talk to an attorney about your possible damages.
