Question
Hello,
I have a new 2008 MErC C-300 it was damaged quite bad in the Hail storm. Because of my comprehensive coverage, the insurance company is covering al my expenses, except for my deductible., But I wanted to know if I could claim Diminished Value for the car too. I'm in Austin, TX.

Answer
Hi Suudarshan,

Unfortunately no. In Texas you can not be paid diminished value under your own policy except for an uninsured motorist claim.

Only when another driver is responsible for your damage can you be paid for diminished value and it would be from them or their insurance company.

I hope this helps
