hello Ron
This is Tahairh the one with the weekend warrior problem. hope you remember.  First thank you very much for your advice I took your advice and hired me an Engineer. He said that my damage was do to being ran off the road gave them evidence and everything still deny me. Called a lawyer he said doesn't matter malefactor defect or not it is still covered.  But any way question? I switch over insurance company in November. I made last payment to progressive on November 11 2008 purchased insurance from gmac on the 24 of November never cancelled my insurance with progressive still have insurance with progressive cause my insurance policy was not up until this month can i legally file a claim with progressive to see if they might cover it.

Sorry for delay, but I did not get your question until today.

Turn in the claim to both insurers. If it is covered, they will split up the costs. Be sure to let them know you are turning it in to both insurers so they don't think you are trying to defraud them.

If the lawyer says it should be covered, send the insurer a copy of his letter. If they still refuse, you may have to sue them, either in small claims court (without a lawyer) or in higher court (with a lawyer). If a lawyer won't take you case on a percentage, then you you will have to pay hourly. It may not be worth the cost, and there is no guarantee you will win. Judges don't always do the right thing.
