Auto Insurance Claims/rental car unauthorized driver accident

Question
I rented a car in NY state and let my daughter drive unauthorized (close to midnight, the representative just shoved the paperwork at me without going over anything).   We were rear-ended and the other driver admitted fault.   Are we responsible for the damages and medical expenses?   If so, is there recourse via the other driver?

Hi Corinna,

You are directly responsible to the rental company since you signed the rental contract. The at-fault driver and his insurance are responsible to you for the damage. You should be able to put the at-fault insurance comapny in touch with the rental car company to get the damages worked out.

Aas far as medical, New York is a state that has PIP coverage. you would have to call your insurance company to see how they will handle this. Any medical expenses in excess of your PIP coverage will be paid by the other insurance company once you reach a settlement agreement.
