I googled betterment laws in Texas and i found that their were court cases which prevented auto insurance agencies from claiming betterment in Texas. Can auto insurance agencies in Texas still claim betterment in order to not pay the full cost of repairing vehicles?

Hi Hank,

I am not familiar with the cases you mentioned. In most cases an insurance company can take betterment on parts that normally wear out over time, such as tires, brakes, shocks, etc.

If there is some case law in Texas that says that an insurance company cannot take betterment, the best place to verify that would be the Texas Department Of Insurance. You can visit their website at www.tdi.state.tx.us
