Auto Insurance Claims - auto accident and seizure

Expert: Anne - 6/28/2009

Question
Person is driving in the state of NJ, has a seizure and gets in a car accident. I do medical billing and as far as I know the claim would go to the patient's auto insurance, but the patient is saying no send it to my health insurance. I believe I am correct and have been trying to research it on the internet but am having trouble finding such answer. I would greatly appreciate your help.
Thanks.

Answer
Hello Pamela,

Auto policies cover auto accidents, and health insurance covers just about everything but auto accidents. The actual seizure is a medical condition not related to the car accident. The injuries caused by the car accident are covered by the auto policy (unless the car accident caused the seizure -i.e, and no the other way around).

This claim should probably be file with the auto insurance if there are injuries accident related (bumps, bruises, etc.). The carrier will have to determine coverage.

in some instances, there might not be coverage for third parties (the person's this person hit), if there is a "medical defense." But that would be beyond the scope of what you are trying to do.

I hope this helps,
