Question I let my son borrow my car one night to drive to practice. He was in an accident, and both parties were not cited. The police said they could not determine who was at fault. However, he is not listed as a driver on my policy. Should the insurance company cover my claim. We reside in California. I have full coverage on the car. The company called and told me one day it will be covered then called the next day to inform me they need more time to investigate.

Legally, any insurance company in California can deny coverage
for an accident caused by any resident of your household who
is not a named driver on the policy.
You have an obligation to your insurance company to inform them
of every licensed driver in your household.
Since you and your son will not be able to file proof of insurance
as required by California Law, each of you will be subject to fines and/or the loss of your drivers license.
If your son is NOT a legal resident of your household and only occasionally drives your car, this claim will be covered after
the insurance company completes it's investigation.
