Can an auto accident that caused severe bodily injury remain open after a settlement (in case of additional/ future complications)?

Hello Dorothy,

Not if you signed a release. But hey, if you are talking about a lot of money, you need to have an attorney look at the release to see if there is a way to invalidate it.

Also, consider a partial settlement on some items, like the property damage, while leaving the injury claim open.

Also pay attention to the "statute of limitations", the time limit to file a lawsuit. Insurers like to trick claimants into overlooking this by dragging out the negotiations.
