Auto Insurance Claims/state farm liability claim

Question
Texas.A guy had a fatal heart attack in front of our house and drove his truck thru our house causing approx.$19,000.00 in damages. State Farm may deny the claim saying he was not negligent, so what are we to do.

Hi Veronica,
The final decision on this will be based on Texas law and not
have anything to do with the legal wording of an insurance
policy.

The best way to handle this situation is to file a claim through
your homeowners policy.  They will pay for the damage to your home under the terms of your policy (less your deductible) and get
involved in the legal battle and do everything possible to have State Farm be responsible.  If they recover in full from State Farm, they will reimburse your deductible.
