Auto Insurance Claims/Rear-end accident

Question
Hi Ron,

Thanks for looking at my question. My car was hit from the behind on 8/11 at highway exit. I've made a claim to state farm which insures the driver, a young woman who hit my car. But she hasn't got back to state farm either by calling-back or answering phone. The claim rep. said they have to get her confirmation first to pay repairs. So, if she still refuses to respond to the claim, what should I do? Just wait? I have to use car frequently. I'm in Texas where accident also happened. Thanks so much in advance.

Best Regards,

David

Answer
If the other driver refuses to report the claim to their insurer, the insurer does not have to deal with you. You have to sue the other driver, and that may motivate the driver to turn in the claim. If the other driver loses in court, their insurer will probably not pay their losses, since they failed to turn in the claim.
