Thanks so much in advance for answering my query.

Last year my two daughters and I were involved in an accident when an SUV pulled in front of our RV. Both vehicles were totaled. My youngest daughter was taken to the hospital for neck pain. She was released late that same day after x-rays and an exam by the doctor. She was told to follow up with her doctor. She had physical theraphy for three months.

We were on our way for a week vacation at the beach. We were at the RV repair place for five days waiting on an insurance adjuster and how to get everything back home once the RV was totaled.  I received about 80 percent of what I had invested in the RV.

The injuries adjuster has made an offer of $7,000 for my youngest daughter. After medical bills she would be left with $2,000. My other daughter (she was driving. She effects her) and I (lost vacation time, worry about in the hospital, dealing with the RV loss, etc) were offfered nothing. I wanted to know if this a fair and reasonable offer?

This has been ongoing for 18 months.

Hello Greg,

Unfortunately, as you are entitled to pain and suffering, loss of vacations/work, and time loss only when your are injured (i.e. you were seen by a medical doctor). If you are not injured (again, a doctor sees you), then you cannot prove your injury. This will leave you with not settlement.

Your daughter was seen by a doctor and thus she is entitled to settlement. Depending on her injury and your state legislation, this may be a low offer.
