Question I and my son moved from Arizona to NJ in September. My car got transfer on an Auto Transport, contract with Transport Company.
I got my car back in NJ but with damage. The driver reported he hid a pool with his truck when my car was on the truck during backwards driving.
The Insurance Company contacted me days later and told my” get 3 estimates”. I got informed; I have to pay on my own a rental car if needed, because the insurance policy insured only cargo and the driver is not responsible nether, because it is Cargo transfer.
All car shops told me for repair they need 4-5 days. The Auto transfer company had in the contract the will not be responsible for any damage of the car.
To go to the daycare and work and home I need a car.

I faxed 3 estimates and got a fax back; I am good to go to repair my car $1344.67 but
The insurance will pay only $344.67 and the $1000 (Deductable from the truck driver) he has to pay direct to me. Is this legal? I have no contact information from the driver beside his name. The insurance company will not give me any information about the driver. How do I get the $1000 from the driver, what possibilities beside “waiting” do I have?
Answer Hello Anne,
Well, you are owed 100% of your damages + the loss of use (reasonable rental car). The insurance company does have a "liability deductible" as they probably have a commercial policy, so you would have to collect against the owner of the company. This can be a problem, but you are going to have to do it if you want to see money.
Your best approach here really is to contact a lawyer to help you get the information and then see how you can collect the entire amount.
Your other problem is that Transport company might be set in different states, so this might be hard to do (the more reason why you need a lawyer).
