Question On 2-26-09, I was a passenger in a car involved in a three-car collision. The car I was in was totalled, and we were driven by a family member to an emergency room to make sure our injuries were relatively minor. My injuries so far seem to be no more than abrasions and bruising, but painful nonetheless. My er bill will be sent to my home. A police officer was on scene and is working on an accident report. There was one driver ticketed who was very clearly at fault (not the driver of the car I was in), and she is insured. So, what do I do now? I'd rather not involve a lawyer, and am only concerned with making sure my medical bills are paid for. Should I expect to be contacted by the at-fault driver's insurance company? When the bill from the er arrives, what do I do with it? Thank you for any information you can give me on what to expect.
Answer Hello Julie,
I am sorry to hear about your accident. I hope you feel better.
The ER bill will be paid by the insurance company of the vehicle you were a passenger in. Their PIP and/or Medical Payments coverage will trigger and pay for your medical expenses up to their limit of liability (could be $5,000 or less).
In addition to this, it is important to note that once you settle your pain and suffering claim, the at fault insurance company will pay back the insurance company that paid for your damages.
